Selling a House With a Tenant Still Living There

Selling a house with a tenant in place is legal, and the lease does not disappear at closing. Ownership changes hands, but existing leases generally survive the sale, and the buyer becomes the new landlord bound by the same terms. Cash Flow Deals can work with the existing lease timeline and lock a net price for the seller upfront, an option that keeps the sale moving instead of waiting for the tenant to leave first.

Does a Sale End the Tenant's Lease?

No. Selling a property does not, by itself, cancel a valid lease. The buyer takes ownership subject to the existing lease and steps into the landlord role, inheriting the rent amount, the term, and the security deposit. There is one common exception: if the lease itself contains a clause allowing termination on sale, or once a fixed-term lease naturally expires, the new owner is in the same position as any landlord at renewal time and can choose not to renew. State landlord-tenant law adds its own detail on notice and how a security deposit transfers, so confirm the specifics with a local attorney before assuming how it plays out.

Why FHA and VA Buyers Are a Smaller Pool Here

FHA and VA financing is built for owner-occupants, and both loan types generally require the buyer to move into the home as a primary residence soon after closing. That requirement does not mesh well with a house that has a tenant under an active lease. The buyers who stay in the running for a tenant-occupied property are usually investors and companies built to handle an existing tenancy, not owner-occupant buyers relying on FHA or VA financing.

What Buyers Actually Ask For

A serious buyer on a tenant-occupied house will ask for a copy of the lease, the monthly rent amount, the security deposit amount and where it's held, and proof that rent has been paid on time. Sellers who gather this paperwork before listing move faster than sellers who scramble to find it mid-negotiation, since a buyer's due diligence on a tenant-occupied property almost always starts here.

Commission and Cost Structure Haven't Stayed the Same

The 2024 NAR Sitzer/Burnett settlement, effective August 17, 2024, made real estate commissions negotiable and moved buyer-agent compensation off the MLS. That change matters for a tenant-occupied listing specifically, since showings are already harder to schedule around a tenant's life, and sellers now have more room to negotiate what they pay for that marketing effort. Cash Flow Deals structures its fee as a separate line item on the closing statement rather than a markup on price, which is a different cost structure worth comparing against a traditional listing.

Selling Options With a Tenant Still in the Home

A seller with an active tenant has three real paths: wait for the lease to end and sell vacant, sell to an investor who plans to keep the tenant, or work with Cash Flow Deals. That process looks like: one, request a net-price review with the lease terms disclosed upfront. Two, get a locked number that accounts for the tenant staying through closing. Three, close through a real buyer matched to a tenant-occupied property, arranged through a licensed local broker partner.

Common questions

Can I sell my house if a tenant is still living there?

Yes. A tenant's presence does not stop a sale. The lease transfers with the property, and the new owner becomes the landlord under the same terms.

Does the new owner have to honor the existing lease?

Generally yes, since the sale does not cancel a valid lease. The exception is a lease clause that specifically allows termination on sale, or once a fixed-term lease naturally expires.

Can I evict a tenant just to sell the house?

Selling a house is not, by itself, a legal reason to evict a tenant who has a valid lease. Eviction grounds are set by state and local law, so confirm the rules with a local attorney before taking that step.

Will FHA buyers make an offer on a tenant-occupied home?

It's less common, since FHA loans generally require the buyer to occupy the home as a primary residence soon after closing. Investors and companies built to work with an active tenancy are usually the more realistic buyer pool.
