Active Contingent: What This Listing Status Means
Published by Cash Flow Deals · Last updated 2026-08-05 · Published and reviewed for compliance by Camilo Palacio, a Florida Licensed Realtor
Active Contingent means a seller accepted an offer, but the contract still has one or more unmet conditions, like the buyer selling their current home, securing financing, or completing an inspection. The listing can still show as technically live in some MLS systems, sometimes still accepting backup offers, until those conditions clear or the deal falls back to active.
| Factor | Traditional Route | Cash Flow Deals |
|---|---|---|
| Contract Status While Under Contract | Deal can sit in Active Contingent or Pending for weeks while contingencies clear | No financing or home-sale contingency needs to clear once terms are agreed |
| Chance the Deal Falls Back to Active | An unmet contingency, financing, inspection, the buyer's own home sale, can cancel the contract | Fewer contingency categories tied to a buyer's own financing or home sale |
| Backup Offer Complexity | Sellers sometimes juggle backup offers while the primary contingent deal plays out | One buyer, one offer, no backup-offer negotiation needed |
Active Contingent vs Active
Active means the house is on the market with no accepted offer. Active Contingent means an offer has been accepted, but conditions in the contract still have to be met before it's a done deal.
Active Contingent vs Pending
MLS status definitions aren't standardized nationally and vary by local MLS, but generally Contingent means real conditions remain that could still cancel the deal, while Pending usually means the property is no longer accepting other showings or offers.
Common Contingency Types That Trigger This Status
The most common ones: a home sale contingency (buyer needs to sell their current home first), a financing contingency, an inspection contingency, and an appraisal contingency.
Can You Still Make an Offer on an Active Contingent Home?
Often yes, as a backup offer, depending on the listing agent and how the current contract is written. Backup offers can be accepted by a seller in case the primary contract falls through.
Why Deals Fall Out of Contingent Status
The buyer's financing doesn't clear underwriting, their own home doesn't sell in time, or the inspection turns up something they won't accept. Any of those sends the listing back to active, and the seller back to square one.
Avoiding the Contingent-Status Loop Entirely
A seller can skip the whole cycle of contingent, back to active, contingent again, by working with a buyer that doesn't carry a home-sale or financing contingency in the first place.
Common questions
Can a home sale still fall through after it's marked Active Contingent?
Yes, if a contingency, financing, inspection, or the buyer's own home sale, isn't met.
What's the difference between Active Contingent and Pending?
It varies by local MLS, but generally Contingent means conditions remain that could still cancel the deal, while Pending typically means the property is no longer accepting other showings or offers.
Can I still make an offer on an Active Contingent listing?
Often yes, as a backup offer, depending on the listing agent and the current contract's terms.
What's a home sale contingency?
A clause letting the buyer cancel the purchase if they're unable to sell their current home by an agreed deadline.
