What Is the MLS? And What Does It Mean to Sell a House Off-Market in Florida?

The MLS, or Multiple Listing Service, is a regional database maintained by local Realtor associations where licensed brokers share property listings with each other, and it's the source data that syndicates out to public sites like Zillow and Realtor.com. Selling off-market means a sale that never gets entered into that database, negotiated directly between a seller and a buyer instead of through public listing exposure. Since August 2024, the NAR Sitzer/Burnett settlement also decoupled buyer-agent commission offers from MLS listings nationally, changing how compensation gets negotiated either way. What the MLS Actually Is

The MLS isn't a government system or a single national website. It's a private, cooperative database run regionally by local Realtor associations, where licensed brokers agree to share their active listings with each other. That cooperation is the entire point: an agent representing a buyer can search listings from every other participating brokerage in the area, not just their own firm's inventory.

Public sites like Zillow and Realtor.com don't generate their own listing data independently. They pull most of it through data feeds from local MLS systems, which is why a new listing often shows up on those sites within hours of being entered.

Since August 2024, following the NAR Sitzer/Burnett class-action settlement, listing brokers can no longer offer buyer-agent compensation directly through the MLS listing itself. What a seller gives up going off-market is broad price discovery, the chance that competing offers push the price higher than any single buyer would offer alone. What a seller gains is privacy (no public listing history, no showings, no days-on-market clock running in public) and often speed, since there's no marketing period before an agreement gets reached.

Neither approach is universally better. A seller chasing the highest possible price in a strong market usually wants broad MLS exposure. A seller who values certainty, privacy, or speed over maximizing the last few percentage points of price is the one for whom an off-market sale tends to make more sense.

Why Some Florida Sellers Choose to Skip the MLS

Listing on the MLS exposes a home to the largest possible buyer pool, but it also comes with a public days-on-market clock, showings on your schedule, and financing risk on the other end. A meaningful share of home-purchase contracts fall through nationally, most often over the buyer's financing, which is a risk that exists on an MLS sale in a way it usually doesn't on a direct sale to an already-qualified buyer.
